St. Charles County deputy to serve prison time for role in meth bust

MONTGOMERY CITY • A St. Charles County sheriff’s deputy was sentenced Friday to serve five years in prison for breaking the law while he and other officers were at a Middletown, Mo., home to apprehend a wanted meth cook.

In August, a jury found Christopher E. Hunt, 38, guilty of felony burglary and misdemeanor counts of assault and property damage after a three-day trial that pitted police officer against police officer.

The charges stemmed from the Feb. 5, 2009, arrest of Phillip Alberternst, who was wanted on several felonies related to meth-making. Hunt and three other members of the St. Charles County Regional Drug Task Force were assisting members of the East Central Drug Task Force — which serves Warren, Audrain and Montgomery counties — with the arrest.

In arguments during the trial Montgomery County Prosecutor Nicole Volkert said officers had agreed to try a consensual search because they didn’t have a search warrant, but when Hunt showed up later, he kicked in a porch door and beat “a helpless, naked man” who was not resisting.

At the sentencing, Hunt broke down several times while reading a prepared statement in which he detailed his military service with the U.S. Marines and his life-long desire to be a police officer.

He said on the day of Alberternst’s arrest, he felt everyone around him was in danger.

“I had to decide in a matter of seconds what it took jurors five hours to weigh,” he said. “My intention that night was not assault, it was safety.”

Hunt’s wife also testified on his behalf, but Circuit Judge Keith Sutherland did not let St. Charles County Sheriff Tom Neer or County Executive Steve Ehlmann get on the stand after Volkert said they weren’t listed as potential witnesses.

Volkert asked that Hunt get 15 years for the burglary, in part because he is a police officer.

“This is the type of person who makes other people doubt the entire system,” she said. “He filed a false police report and lied to cover it up.”

Hunt’s attorney, Joseph McCulloch, argued for probation.

“His law enforcement career is ended; the ability to support his family is crippled,” he said. “I don’t know what message putting him in jail would send.”

But Sutherland said he agreed with the jurors that Hunt had gone to the scene that night with the intent to get revenge on Alberternst, then “made up facts to make himself look good.”

He said it was common knowledge that police officers stick together.

“In this case we had law enforcement officers from four different agencies testifying against another officer, and that’s very telling to me,” he said.

Hunt plans to appeal his case to the Missouri Court of Appeals, and he remains free after posting 10 percent of a $100,000 bond.

After the hearing, county officials tried to write a check for Hunt’s release, but Sutherland would not allow it.

“I don’t know whether it’s normal or not, but we’re supporting our people,” Ehlmann said later. “People don’t understand what a tough job these guys have.”

Ehlmann said that Hunt had paid $5,000 of the bail money, and Neer had paid the other half.

Three other St. Charles County officers — William S. Rowe III, Dion E. Wilson and Deric Dull — also are charged with misdemeanor counts of assault and making a false report in the arrest. No trial date has been set in those cases.

Alberternst, who was sentenced to 10 years in prison, is now on parole and living in a medical facility because of health issues unrelated to the arrest. In February, Alberternst was awarded a $70,000 settlement after he filed a federal civil suit alleging assault and excessive force. The officers did not admit any wrongdoing.

All the officers were cleared by their departments after internal investigations, and Hunt had remained on administrative duty even after the guilty verdict.

    Everyone who ‘feared for their safety’ could have rounded up the posse and headed back to the precinct, and no harm would have come to anyone, after all they were all outside of the house at that time and could have simply left the premises.

    But no! the ‘cowboy cop’ had to escalate the situation by kicking in the porch door.

    How do convicted drug users support their families when they are sent to jail?

    Then at his trial he cries like a baby for being given the lightest possible sentence.

    On top of it all…….. he is still employed as a cop!

    Who else in the USA could be guilty of such a crime and still remain on the payroll? Oh yes, that’s right– only cops, and perhaps the mafia. Certainly not upstanding human beings.

    Therefore, ‘cowboy cop’ is not an upstanding human being. He is a deviant. A hollowed-out soulless non-human.

    Lock him up and throw away the key for agrivatedly agressing against written laws and all common sense.

    Allow his family to feel what thousands of other families have felt, as their source of support has been sent to prison on drug charges.

      I agree. I’d go a little further and say that all the holy “LE Heroes” involved in this thing are no different. Their tall tale about a “consensual search” looks like a feeble lie.

      They were more likely there robbing the dope cooker, and keeping it all low key so it wouldn’t attract attention when this dimwit who wasn’t invited in on the deal comes busting in and just fucks it up for everyone. I can’t picture cops testifying against cops except to save their own skins or to protect their own profitable rackets.

    • Given the almost daily revelations of police brutality, is it not reasonable for any Mere Mundane to fear for his safety when pulled over by a cop? God only knows what they are going to do… .

      If we act precipitously – based on that fear (legitimate, plausible fear) – the repercussions for us will be immediate and severe.

      But an armed cop – who has far less reason to fear for his safety – can get ultraviolent on an unarmed Mundane and the repercussions, if any, will be mild.

      This double standard ought to enrage people.

      That it does not is testimony to the effectiveness of the conditioning – of the average person’s total immersion in the myth of authority.

        I also had a gigantic shooting match against the Statists over on some dinosaur media website, about that piece-of-shit cop who shot at the minivan full of kids in New Mexico. Ya’know, ’cause she ran away.

        Well after reading about the proctology exams in NM, if I were getting pulled over there I’d run too! In fact I should be worried right here in Texas; there have been at least three cases of roadside digital exams. The fat dyke bitch who did the most famous one to an aunt and her niece was fired but not criminally charged. Another case, read it here, the bitch was re-hired after digitally raping two women.

        I am dead certain I’d pursue extra-legal avenues in exacting revenge if this happened to a member of my family.

        These people need to start dying.

    Sounds like the Menendez brothers at sentencing. The defense attorney made a plea for limited jail because they lost their parents. WTF?

Kitty, awakened by the shots, sprang from the couch and ran for the hallway but was shot in the leg, causing it to break. She slipped in her own blood and fell, then was shot several times in the arm, chest, and face, leaving her unrecognizable. Both Jose and Kitty were then shot in the kneecap in an attempt to make the murders appear related to organized crime.   3. To obscure what is happening, you get all kinds of stories about societal breakdown, and rogue cops.

    Certainly, our right to be secure in our home is important. It is one of our natural rights. It infuriates us to see those paid to protect our rights, violate them instead.

    More important, is the necessity to be a society of laws, laws in harmony with natural law. When laws multiply and conflict, when law becomes whatever the soldiers say it is, there ceases to be any law at all. Only a brute free for all, where laws are arbitrarily upheld or breeched, according to the whims and fancies of the petty dictatorships found in every precinct.

    Most important, is to be a society of consistency, and black and white consequences and reactions. _ven a pack of dingos or coyotes have a customary way of dividing the spoils of the hunt.

    It is because our society has suicidally turned its back on this most ancient bedrock principle of to the victor, the spoils, that our society is crashing down around us. Without sound money, there can be no righteous laws or human rights.

    Its as if the dingos were handing over their kill to the lions. The lions don’t protest, they live like kings. Eventually the starving dingos come around begging for scraps and charity from the lions.

    Incredibly, the dingos blank out all memory of it being their kill, and instead go to work serving the whims of the lions. Quite oblivious to the twisted subservience of their misguided gratitude, they toil tirelessly to build huts for the aged lions, boats for the aristocrat lions, and even harnesses for the lions to put around the packs of dingos that pull around the leisure class lion’s carts.
