Many in Virginia are alarmed by what Virginia is becoming. In particular, they do not like that local sheriffs are to be subordinated to the state police, which effectively means to the state government – which is now controlled by a relative handful of “blue” (i.e., Democrat-controlled) counties orbiting DC. The rest of the state is effectively disfranchised.
One of the people alarmed by what is going on in Virginia is an EPautos reader. He has written a letter addressed to his local sheriff, L. J. Ayers of Amherst County – but it pertains also to the people of Virginia generally. I reprint it here:
I am 65 years old and I have lived my entire life in Northern Virginia. I was born in Washington D.C. itself. Having grown up in the county where the idea of separation from tyranny was born (Fairfax County), names such as George Washington and George Mason are not just people from the past. They are heroes to all who believe the United States had a right to exist. Mason put the idea on paper first and it was adopted as the Virginia Declaration of Rights on June 12, 1776. Those “rights” were in rough draft in May and were handed to another well-known Virginian in Philadelphia City at the Continental Congress. That delegate was Thomas Jefferson who used the third section of the Virginia Declaration and adopted the words of power from the “Public Weal” to introduce the Declaration of Independence to King George III as to how the people have the right to separate from their government.
“The Public Weal” meaning “the public body politic” as in the sense of a town hall expression or a meeting of the people who have the right to vote to come up with their own resolves for self-governance. This term was a quote, twice given by King James 1st and used by John Locke as the main reason why any people in the kingdom have the power and the right to not follow the King. The King was speaking to the Parliament; the gist of it was that if he was not doing a good job, then he would trust the mental capacity and decisions of the “the Public Weal,” which is how those words end up by George Mason’s hand, into the Virginia Declaration of Rights, item number three. It also currently sits in the Virginia Constitution, Article One, Section Three.
“That government is, or ought to be, instituted for the common benefit, protection, and security of the people, nation, or community; of all the various modes and forms of government, that is best which is capable of producing the greatest degree of happiness and safety, and is most effectually secured against the danger of maladministration; and, whenever any government shall be found inadequate or contrary to these purposes, a majority of the community hath an indubitable, inalienable, and indefeasible right to reform, alter, or abolish it, in such manner as shall be judged most conducive to the public weal.”
The expression, of “Representative Government” takes the form of a Republic. The expression “Democratic” is in the form of a Democracy. No matter which system you prefer, neither presents the ideas derived from Thomas Paine’s Common Sense fully. However, the people from New England, had much more power over their governments than did the people of the Mid-Atlantic or Southern states. As of the end of the “War Between the States” or also known as the US Civil War, all states have mostly operated in the model presented by the U.S. Constitution itself.
In 1774 and 1775, men who had been previously elected as Burgesses to the House of Burgesses and who had suffered twice the Royal Governor’s wrath in being disbanded, decided to form conventions to look for a new path forward for the people who legally elected them. George Mason, in communication with George Washington, suggested that since they were the last “elected” representatives of the Freeholders and Freemen, that they should take the power given to them by the people to use the same position as delegates to a convention.
The Conventions are where the decision to leave England and form their own new state was born. The anniversary of this is June 12. Our first constitution followed on the 29th.
My bringing that example forward from that period, along with the tyrannical actions of those who had been entrusted with the power of managing the public welfare and saw what an illogical and dangerous usurpation of power by another office inside of the colony was able to accomplish, fits your current situation perfectly. The people we now know as “Patriots” correctly chose to break away from their nation and begin a new one in the name of self-governance and liberty. Except in this case, you would be breaking away from Virginia to form a new state. A state which can petition the US Congress for the position of the 51st state.
Many legal minds make a great deal of money on social media by covering what the Republican Party wants them to cover. I point out that one only has to notice how fast the Republican Party jumped into gear to stop a redistricting scam that was “approved” by Virginia votes and not necessarily voters. The absentee fraud in Northern Virginia is horrific and the GOP refuses to attack it. I also noticed how silent the GOP was when these ex post facto laws were illegally pushed on all of us. You will note that even those who look at the Virginia Constitution, skip to Article One Section 13 and go right past Section 11, where you will see the directive that “no ex post facto law” shall be made. Nobody wants to let those words out of the cage because that will enlighten all people to review all laws including tax laws and the fear is that big government will be no more. The words “no ex post facto law” also show up in the US Constitution a number of times and it was the attempt of the Federalists to soothe the worries of those who opposed the constitution that had no Bill of Rights at its head. We are moving from Virginia, because I have been illegally made into an ex post facto criminal.
Today, I write you to make you aware that recent activities by members of a political party that gained control through voter registrations that are filled with names from cemeteries that have no mechanism to clear these fake names or catch them as they are registered and show up as absentee votes and the consequences of believing that the Northern Virginia counties have actual absentee ballot participation over 1,000 times than that of the other counties across Virginia. The consequences of such a stolen election has shown itself as a Nazi-style takeover. Hitler also took control of Germany through a rigged election in similar form and then used his political party to stomp on the people who had been made weak by the previous war.
HR 1525, has in fact waved off the powers of the Sheriff in all counties of Virginia. You have been illegally made subordinates to the State Police. Until now, whenever a Trooper enters into any Virginia County they would immediately be subordinate to the Sheriff’s office. This has always been the case. Now, your power has been stripped away.
HR 1525: That the Department of State Police shall administer, enforce, and otherwise implement § 18.2-308.2:5 of the Code of Virginia from the effective date of this bill.
The talk of the legislature now considering a Nazi-like like maneuver to clear the Virginia Supreme Court and refill it with politically correct lawyers, is yet the same as what happened to the Sheriffs and what happened to you is on the order of what happened to the Two House of Burgesses.
When any part of any government refuses to be open to inspection and correction, (such as the Northern Virginia Registrars) then that part is no longer operating under the control of the people. That is why George Mason designed the Declaration of Rights, which was adopted by all thirteen colonies when they became states and all fifty states, or to be used as components of it in their Constitutions, just as Virginia uses it in hers. That Declaration brings to life the power to act “…whenever any government shall be found inadequate or contrary to these purposes, a majority of the community hath an indubitable, inalienable, and indefeasible right to reform, alter, or abolish it, in such manner as shall be judged most conducive to the public weal.”
George Mason’s suggestion to George Washington to populate conventions to start a new government be populated by those who had already been chosen by the people to represent them; this how the convention was populated by the former Burgesses. Without the understanding that the entire process leading towards liberty was from the opinion of one leader; the people will always keep groping in the dark for an answer that will never be found.
My suggestion to you, is that you first hold a convention of Sheriffs from those counties who agree on their disposition caused by the illegal actions of a legislature and a governor who took office with questionable votes of which the Republican Party, refused and continue to refuse to question. Your first convention would hopefully conclude with a plan to hold a broader convention with delegates who are interested in starting a new state which will be carved out from the old Virginia. Take as many conventions as you need but don’t give up. The forces that are against you, intend to reverse 1776 and recreate a tyranny of the kind only Europe can design.
Try to keep those counties along the ridges with WVA from entertain the thought joining WVA because a closer look at the differences between the WVA Constitution and our current Virginia Constitution will find a number of differences and lack of a few personal rights, one of them being that the State of West Virginia has the right to force their residents to take vaccines, regardless of your objections. Please, be aware of melding with WVA.
Being a New State will take away stolen or engineered theft of votes from the old Virginia and diminish their power as a rogue state. You are not leaving Virginia in this case as Virginia has left your people. You can easily petition congress to become a state and this should be very easy, especially because of the National Assets, which already exist there.
Make political parties illegal in your new state. These have been the soul source of unrest un unhappiness in our state and the other forty-nine states. This may feel uncomfortable to you but as you have witnessed over the past six months is that when Republican Party felt it’s party would lose power to raise funds across Virginia under the latest redistricting attempt, they jumped out of their chairs with prepared plans to bring that attempt to a stop, however, when they witnessed the election fraud and the illegal creation of ex post facto laws to take guns from law abiding Virginians, you could hear a pin drop. All we have seen are a few brave Sheriffs to come out publicly and defend law and order, however the party still remained silent and their Delegates and Senators released news letters after their great failure and never printed one word against the ex post facto anti-gun laws as far as I could tell.
I urge that you consider starting your new state on the model of the old Virginia model of Freeholders and Freemen that has transformed itself into the modern voting rights of today, and combine them with the Town Hall Selectmen process to keep local control in the hands of the people and use the local political weal as the second body of a bicameral state legislature. What a house of representatives creates as bills, are sent to the Town Halls for consideration. If the people put a stop on it, then it’s done. If the people give their approval, the bill moves on for changes and reconsideration or to a signature of the governor.

The cobblestones comment is correct. I always say, the US Constitution has no teeth in it to protect itself. One has to remember, the men who designed our governments were wealthy for the most part. They liked power. The Freeholders and Freemen, in Virginia were the only ones who had the right to vote. This is of course something that time and hue and cry have corrected. That is why you can make it work today. You won’t have any of those “courts” until you form a new government. Arresting the bad people is not a winning game. Force them out and never letting them return is the key, but your new state Constitution, must have teeth. Assign the definition of maladministration and assign a penalty for it. Then you can start sending them to court.
Ernie, the US Constitution is a flawed document. It was narrowly adopted without any “bill of rights.” Even James Madison said a bill of rights was a waste of time as they had already trampled on the Virginia Declaration of Rights by 1787. New Hampshire still allows their Selectmen groups to formulate bills and send them to their state house to be voted on. The local people, still have some input there, however they too allowed the Board of Supervisors model to take over and have since regretted it. Can you find the actual sentence in the US Constitution that says it was tasked to make a “republic”? Thomas Jefferson was once queried on that very question and he declared our new nation was a Democratic-Republic.
Bryce, I know people from Illinois as well who feel the same way. Think of it, SW Virginia would gain two US Senators and nullify the other two in old Virginia. They would also gain a seat or two in the House. I know Californians would benefit from it as well.

Article 4 section 4 guarantees a republican form of government to the several states. The federal government itself wasn’t defined as it was more of a treaty organization like NATO focused only on interstate controversies and external threats.
Yes the Constitution is flawed, nothing done by man is perfect. But its still the law of the land and a useful tool.
Ernie, you left a little bit out of that section four:
The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence. Our constitution does not direct us on how to enforce that directive of “against in Invasion” and so on.
The Constitution also directs how representatives are picked and that is through elections. Democratic processes. The description of how the SCOTUS operates doesn’t say it is to be a Republic. It operates as a democracy inside of republic, built by Democratic means. “A Republic Form of Government” does not mean a “republic”. The word “Form” is not a directive but a loophole. It’s not only imperfect, it has nothing to do with Virginia and other states who need to be separated for liberty’s sake. Especially since the US Constitution’s lack of teeth and the overwhelming need of the Political Parties to create ex post facto laws and further break their oath to the contract they serve.
The 10th amendment clears the way for new states to be formed and if you think I’m wrong, then you better tell WVA and Kentucky to get back home in a hurry and NJ needs to go back to NY in a hurry.

Yes, we allow democratic elections. That does not in any way make us a democracy. A democratic election is a plebiscite- a way of rejecting the management running the institutions that are formal government. Democratic elections are usually preferable to combat for transitioning power.
Unfortunately the standard political science references are wrong- they attempt to characterize a republic as a representative democracy. The problem being is that words mean things- a republic is a public thing- a “Res Publica” which concerns itself with public matters. A representative democracy is a different thing which has people elected with the power to do whatever the hell they want if there is a claim that 50% plus one wants it.
I absolutely agree that people have the right to secede, to form new governments which respect their rights and honor their traditions, especially in times like this where revolutionary communists are usurping power in so many places and establishments like SCOTUS are severely and almost entirely derelict in their duties.
If Jefferson said the Constitution is not a suicide pact, he was at least partly wrong. The very reason we have a second amendment is to ensure that government NEVER has a monopoly on force and that the people individually or in groups may effectively make tyranny too expensive to operate.

I never said we were a Democracy! You must be a party person. I have found it amazing as to how people throw the word “Republic” around and think that it stands for Life, Liberty and the pursuit of happiness. If you think I’m wrong, then ask the people in North Korea how they like their Republic. Ask the people from Russia how they like theirs or the people in the old East Germany how they liked their Republic or perhaps we should dig Plato up and ask him how fair his Republic was?
We don’t have a plebiscite if the voter roles are filled with dead people voting which is the case in Virginia.
The Congress is a small Democracy as well. They make their laws by counting votes! What’s “republic” about that?
Jefferson called it a Democratic Republic. That is what it is. The Democratic side picks the Republic side. Guess what! New England had it better. The bicameral idea was best. That’s how the states ran before the very narrow adoption margin of the Constitution. Again, if the US Constitution has useless language that is being ignored for reasons of protecting a power base by the political parties, then it is of no use to us.
The State Constitutions have great language and they are ignored by the same people. Political Parties. Thomas Paine spoke of how the party names would never be spoken of in the new nation. At the beginning, they were not around Ernie.
WE can have all the 2nd amendments we want. That won’t stop a full on Bolshevik style revolution, such is what is happening in Virginia and if you think pulling a gun on somebody is the answer to stopping these guys, may you be the guy on the front of the line to make the first shot in defense. How many innocent people are going to be SWAT teamed and red flagged to keep you sitting in your position of do nothing because the words on parchment will protect us?
Sorry if you don’t like my agreeing with the position of separation. The only time I think Jefferson was wrong was when he agreed to support the constitution without a bill of rights to lead it off. In his words to Madison, “half a loaf is better than none.” There, he was wrong. We had a loaf and it was called the Confederation of States.
Be that as it may, you will be forced some day to decide whose side you will be on. I hope you’re on the right side.
Oh, and it was the Confederation of States agreement that was set up as a treaty organization. Its detractors whom we call “Federalists” claimed it did not have enough governing power over the nation as a whole. The men who offered to amend the original contract and did not support the complete replacing of it with a larger form of government were branded “Anti” as in “Anti-Federalists” whose writings never enjoyed the wide-spread publications that the Federalist papers did. They were only printed in the Virginia Gazette in Richmond and in a paper in Philadelphia. The rest of the new nation, never saw their writings and still, the ratification of the new contract made it only by a hair. The nation was not born in 100% of the hearts and minds of the people. Only half. It failed to live up to its supportive half, a long time ago. Ex post facto law. I forget how many times it said it and yet, people of the political parties, don’t like to use it. Why? Are those words not there to protect us?
I never said the Constitution set up a treaty organization, but something akin to a treaty organization. The Constitution set up a long series of very specific federal government functions, not among them was being a general government. The functions of tariff, war, common currency, adjudicating disputes between states, and foreign treaties were to be incorporated to the federal government. The few powers delegated to it were only supposed to be for implementing those.
Most people have never read the Constitution. I have several times, and I suppose I’ll have to re-read it again one of these days soon. I also acknowledge that governments at every level have usurped powers they were never granted or were in fact explicitly denied.
You need to look at the “no ex post facto law” portions. If they are going to be ignored then the area of protection of our rights intended by the Federalists (Federalism by definition is the same as a Federated and Confederation. The later derived from the application of Latin and Spanish where the word “con” means “with”)
People have not read the constitution and even fewer, the Declaration of Independence let alone heard of the Virginia Declaration of Rights.
1776 was not the first time a correction was tried. In Virginia, it was tried in 1676 in an effort led by a man by the name of Nathaniel Bacon, taking on a corrupt Royal Governor and his wealthy landowner friends. The Governor made a deal with the local Indians to run off or kill the newer land settlers who were clearing more land as they went. The Governor’s friends would then absorb those newly cleared lands.
The movement was purposed by the reasoning that Bacon and his followers were merely putting the English Constitution back in power. They thought the King would approve. Bacon forced the Royal Governor out but when Bacon returned to his home near Tappahannock, Virginia, he died suddenly with not explanation. As it turns out, there was a head clerk in the Virginia Company correspondence office who handled all the letter coming from the colony who witnessed the descriptions and pleas for help from the crown to do away with the corrupt governor. His name was none other than John Locke. The same man who later would right his Second Treatise f Government.
Thomas Jefferson, George Mason, Richard Henry Lee and George Wythe were well versed in Bacon and did not want to market he same mistake. Procedure would be the way and declarations would be the point of the spear. 250 years ago this day, the convention of former burgesses, now calling themselves “delegates” were crafting their first constitution. Light Horse Harry Lee had already dropped off the first drafts of Mason’s Declaration of Rights to Jefferson in Philly. Virginia was free, whether or not the other colonies were to follow.
I’m trying to put you down Ernie. I’m glad you’re a modern bibliophile, however not every person who wants to carve a new state out of the old one, has the goal of leaving the Union. However, when people are going to be killed for not breaking any natural laws, and the agreement of domicile offers no protection other than to call it “political will”, then the people have the right to change it or abolish it. It needs to happen. The Communists have gone too far, too fast and they will not slow down. It is obvious that they control both the major parties. Just yesterday, the Lynchburg GOP party was closed down by the state GOP offices. They were running “firehouse” primaries which have been a long running Virginia tradition. No explanation given. They just got shut down. The past Virginia election saw the GOP not put up a full list of candidates for all 100 districts. There was no way they could have won any kind of majority. The takeover from the Democrats was fixed. By the way, you won’t find support for the creation of Political Parties in either the US or Virginia Constitutions.

Vince, I believe we’re in agreement. Ex post facto is vitally important. So is the second amendment. Both are black letter law being blatantly trampled and ignored by small c communists. And those communists do run both parties and control formal power in these states.

There’s a flaw in the freedom formulation above. It doesn’t provide a legitimate mechanism. Where is the citizen’s committee and court whose sole duty is to identify, arrest and jail any and every lobbyist, bureaucrat or politician who even votes to violate the Constitution? What is the mechanism that forces our rulers to put real skin in the game? There isn’t one.
We have all kinds of courts, many of them based on dodgy-as-fuck legislation, we have rules and regulations that hammer the peasants for trivial non-transgressions, but we have nothing by which to hold the bastards accountable, other than the ‘right to revolt,’ which will of course get you killed lickety-split.
The game was rigged from the start.
These approaches are all beating around the bush. The US Constitution requires a republican form of government, not a democracy. Which is to say the government may only concern itself with a limited number of public things. Every individual citizen is sovereign and nobody gets a vote on most of what he is and does.
The enemy is the democrat, the communist revolutionary. Until he is completely defeated, killed, converted, or acknowledges the errors of his ideas, he will continue to torment you. These people believe they have the right to rule you, if they succeed, they do.
I could also see a similar dynamic playing out in Pennsylvania and New York.
Western, central, and eastern Pennsylvania are actually three different states: You drive from Pittsburgh to Philadelphia, and you’ll find it hard to believe you’re in the same state.
As for New York, it’s a red state with a large blue metropolis.
