We’re told that “driver assistance technologies” make cars safer by making crashes less likely to happen – as for example by having the car apply the brakes when the driver doesn’t. This of course assumes the brakes need to be applied – and also that it is safe for the car to apply them.
What if it isn’t?
A news report details one such incident involving the driver of an SUV that decided it was necessary to slam on the brakes – in order to avoid a plastic bag that wafted across the highway.
This is something that has happened to most of us at one time or another. The part about the bag, I mean. Or a tumbleweed. We don’t slam on the brakes because we can see it is a plastic bag or a tumbleweed or some other such thing that won’t cause us or our vehicle any harm if we just drive over it. But automatic emergency braking (AEB) sometimes cannot tell the difference between a bag wafting across the lanes of a highway and a child running into the path of traffic – because there is no brain interpreting what is seen by the cameras or sensed by the sensors (such as radar) that are “watching” the road ahead.
Which they aren’t, really.
At least, not in the sense that human beings see things – and then use their brains to interpret what they see. A human eye (and brain) can discern the difference between a plastic bag and something it’s important to brake for. AEB sometimes can’t. And – as the man driving the SUV discovered – it can be very dangerous when the car decides to slam on the brakes when there’s no good reason to brake. The man described almost being rear-ended by the vehicle behind him.
This was not an isolated incident.
“ Federal investigations have already been opened into multiple automotive manufacturers over AEB malfunctions, with thousands of complaints filed by drivers who experienced unexpected braking events,” says the MSNBC piece.
I am one of those drivers.
A couple of years ago, I was driving a brand-new press car – meaning, a new car loaned out to car journalists for the purposes of a test drive, so as to write a behind-the-wheel review – on a road with nothing in front of me when for no good reason – such as a car ahead that had slowed that I did not see or a kid in the road – the car decided there was a sudden need to brake. Hard. Like the driver in the MSNBC news story, I was very glad that I didn’t get rear-ended. But the fact is that – like the man in the story – I might have been. More finely, I might have been killed.
Him, too.
It does not seem very “safe” to me.
More finely, it does not seem very “safe” to me to not have full control over a car’s critical systems, such as the braking system. Not just because it is manifestly unsafe for a car to slam on the brakes for no good reason but also because it undermines agency; i.e., that it is the driver who is responsible for the driving. Legally, I mean.
Who would have been at fault if the suddenly braking car described in the news story had been rear-ended? Can the person behind the wheel who did not touch the brakes be blamed and held responsible for what the car did? For the damage – including possibly physical harm to people?
It is hard to see how, at least by any moral reckoning.
Speaking of which: This isn’t even a matter of people choosing to drive AEB-equipped vehicles. The “technology” has become de facto standard in most if not all current model year vehicles, irrespective of make or model – in anticipation of a federal mandate that all new vehicles be equipped with this “technology” by 2029, which is now less than three model years away.
The car industry, in other words, isn’t just going along with this – it is getting ahead of this.
There’s an even more ominous aspect to all of this. It is that once AEB becomes a government-mandated “safety” system, the federal safety apparat is likely to warble that older vehicles that do not have AEB constitute a road hazard. The argument will be that if AEB-equipped vehicle “A” brakes – for good reason or not – and the vehicle following does not have AEB, it is likely to run into the AEB-equipped vehicle because . . . ta-dum . . . it does not have AEB.
If it did, they will say, such rear-ender accidents would never happen.
Therefore, older vehicles that do not have the “technology” must either be retrofitted (a technical/economically tenable impossibility for any pre-drive-by-wire vehicle, which means pretty much everything made before around 2010 or so) or retired.
That is to say, made illegal to operate on the government’s roads.
In the name of saaaaaaaaaaaaaaaafety.

Actually a plastic bag CAN cause harm to a car. Many years ago I was in a passenger in a car where exactly that happened, the bag got caught up in the cooling fan and destroyed it. We spent the rest of the drive back home (it was like a 4 hour drive) worrying about having to stop as the car started heating up the minute you did.
That being said, hitting the brakes is a much greater danger than the bag could ever be.
I had a plastic bag get stuck (and melt) to a hot catalytic converter.

I experienced an AEB event on I-40 in a rental SUV a few years back.
Luckily the car obeyed when I punched the gas to override its bad decision.

Ironically real road hazards like potholes or small boulders on the highway (we get plenty of both out in my neck of the woods) are completely ignored. Your “driver assistant” will happily drive full bore into a pothole without pause. I’ve seen it first hand many times in my Cherokee. In fact, if I have lane-keep engaged it will push me back into the center of the lane, where the potholes live.

50yrs? ago, my mom drove over one and it got wrapped around the input shaft of the differential, and it kept winding and winding until it destroyed the shaft seal.
I’ve also seen them stuck on the front of cars impeding airflow.
A friend of mine accidently ran over a furniture blanket on the interstate. It wrapped itself around the drive shaft, caught fire and burned his pick-up to the ground.

In all states, it is the responsibility of the following vehicle to maintain adequate following distance appropriate for conditions to avoid a collision.
Where this is going to go south is that it is also illegal to brake check a following driver. Usually this is hard to prove but dash cams are changing that game.
Where it’s going to get interesting is when the brake checking drivers (whether road raging or seeking insurance fraud) begin to clam that AEB actually did the braking.
Of course the black box will be able to prove who dunnit beyond a shadow of doubt but it’s going to be much harder to get that data to prove the brake checker was acting on their own.
Think of it as AEB giving cover to fraudulent claims. Ie the government mandate for AEB will lead to more fraud and raise all our insurance rates. But of course the goverment won’t care and the insurance companies will make out like bandits. Win-win from their perspective.
And I’ll name a new car I refused to buy when I was told the build date would be the month after AEB was being fitted as standard equipment – VW UP! GTI

Braking Bad sounds like a good name for a new TV show. Regarding the white bag on the road; in the winter if it wasn’t moving you might assume it was a large chunk of ice and swerve to avoid it.
As for the cars that slam on their brakes; my understanding is that they go after the driver following the car that got hit because they were supposed to be paying attention. But knowing GovCo they might just ban every old car for safety but I’m guessing they might not do that because while the bureaurats would do that the effect on the politicians that signed off on this might end their ride on the gravy train.
