A New Virginia

Many in Virginia are alarmed by what Virginia is becoming. In particular, they do not like that local sheriffs are to be subordinated to the state police, which effectively means to the state government – which is now controlled by a relative handful of “blue” (i.e., Democrat-controlled) counties orbiting DC. The rest of the state is effectively disfranchised.  

One of the people alarmed by what is going on in Virginia is an EPautos reader. He has written a letter addressed to his local sheriff, L. J.  Ayers of Amherst County – but it pertains also to the people of Virginia generally. I reprint it here:

I am 65 years old and I have lived my entire life in Northern Virginia.  I was born in Washington D.C. itself.  Having grown up in the county where the idea of separation from tyranny was born (Fairfax County), names such as George Washington and George Mason are not just people from the past. They are heroes to all who believe the United States had a right to exist. Mason put the idea on paper first and it was adopted as the Virginia Declaration of Rights on June 12, 1776. Those “rights” were in rough draft in May and were handed to another well-known Virginian in Philadelphia City at the Continental Congress.  That delegate was Thomas Jefferson who used the third section of the Virginia Declaration and adopted the words of power from the “Public Weal” to introduce the Declaration of Independence to King George III as to how the people have the right to separate from their government.

“The Public Weal” meaning “the public body politic” as in the sense of a town hall expression or a meeting of the people who have the right to vote to come up with their own resolves for self-governance. This term was a quote, twice given by King James 1st and used by John Locke as the main reason why any people in the kingdom have the power and the right to not follow the King. The King was speaking to the Parliament; the gist of it was that if he was not doing a good job, then he would trust the mental capacity and decisions of the “the Public Weal,” which is how those words end up by George Mason’s hand, into the Virginia Declaration of Rights, item number three.  It also currently sits in the Virginia Constitution, Article One, Section Three.

“That government is, or ought to be, instituted for the common benefit, protection, and security of the people, nation, or community; of all the various modes and forms of government, that is best which is capable of producing the greatest degree of happiness and safety, and is most effectually secured against the danger of maladministration; and, whenever any government shall be found inadequate or contrary to these purposes, a majority of the community hath an indubitable, inalienable, and indefeasible right to reform, alter, or abolish it, in such manner as shall be judged most conducive to the public weal.”

The expression, of “Representative Government” takes the form of a Republic. The expression “Democratic” is in the form of a Democracy.  No matter which system you prefer, neither presents the ideas derived from Thomas Paine’s Common Sense fully. However, the people from New England, had much more power over their governments than did the people of the Mid-Atlantic or Southern states.  As of the end of the “War Between the States” or also known as the US Civil War, all states have mostly operated in the model presented by the U.S. Constitution itself.

In 1774 and 1775, men who had been previously elected as Burgesses to the House of Burgesses and who had suffered twice the Royal Governor’s wrath in being disbanded, decided to form conventions to look for a new path forward for the people who legally elected them.  George Mason, in communication with George Washington, suggested that since they were the last “elected” representatives of the Freeholders and Freemen, that they should take the power given to them by the people to use the same position as delegates to a convention.

The Conventions are where the decision to leave England and form their own new state was born.  The anniversary of this is June 12.  Our first constitution followed on the 29th.

My bringing that example forward from that period, along with the tyrannical actions of those who had been entrusted with the power of managing the public welfare and saw what an illogical and dangerous usurpation of power by another office inside of the colony was able to accomplish, fits your current situation perfectly.  The people we now know as “Patriots” correctly chose to break away from their nation and begin a new one in the name of self-governance and liberty.  Except in this case, you would be breaking away from Virginia to form a new state. A state which can petition the US Congress for the position of the 51st state.

Many legal minds make a great deal of money on social media by covering what the Republican Party wants them to cover.  I point out that one only has to notice how fast the Republican Party jumped into gear to stop a redistricting scam that was “approved” by Virginia votes and not necessarily voters.  The absentee fraud in Northern Virginia is horrific and the GOP refuses to attack it.  I also noticed how silent the GOP was when these ex post facto laws were illegally pushed on all of us. You will note that even those who look at the Virginia Constitution, skip to Article One Section 13 and go right past Section 11, where you will see the directive that “no ex post facto law” shall be made.  Nobody wants to let those words out of the cage because that will enlighten all people to review all laws including tax laws and the fear is that big government will be no more. The words “no ex post facto law” also show up in the US Constitution a number of times and it was the attempt of the Federalists to soothe the worries of those who opposed the constitution that had no Bill of Rights at its head. We are moving from Virginia, because I have been illegally made into an ex post facto criminal.

Today, I write you to make you aware that recent activities by members of a political party that gained control through voter registrations that are filled with names from cemeteries that have no mechanism to clear these fake names or catch them as they are registered and show up as absentee votes and the consequences of believing that the Northern Virginia counties have actual absentee ballot participation over 1,000 times than that of the other counties across Virginia.  The consequences of such a stolen election has shown itself as a Nazi-style takeover. Hitler also took control of Germany through a rigged election in similar form and then used his political party to stomp on the people who had been made weak by the previous war.

HR 1525, has in fact waved off the powers of the Sheriff in all counties of Virginia. You have been illegally made subordinates to the State Police. Until now, whenever a Trooper enters into any Virginia County they would immediately be subordinate to the Sheriff’s office. This has always been the case. Now, your power has been stripped away.

HR 1525: That the Department of State Police shall administer, enforce, and otherwise implement § 18.2-308.2:5 of the Code of Virginia from the effective date of this bill.

The talk of the legislature now considering a Nazi-like like maneuver to clear the Virginia Supreme Court and refill it with politically correct lawyers, is yet the same as what happened to the Sheriffs and what happened to you is on the order of what happened to the Two House of Burgesses.

When any part of any government refuses to be open to inspection and correction, (such as the Northern Virginia Registrars) then that part is no longer operating under the control of the people. That is why George Mason designed the Declaration of Rights, which was adopted by all thirteen colonies when they became states and all fifty states, or to be used as components of it in their Constitutions, just as Virginia uses it in hers. That Declaration brings to life the power to act “…whenever any government shall be found inadequate or contrary to these purposes, a majority of the community hath an indubitable, inalienable, and indefeasible right to reform, alter, or abolish it, in such manner as shall be judged most conducive to the public weal.”

George Mason’s suggestion to George Washington to populate conventions to start a new government be populated by those who had already been chosen by the people to represent them; this how the convention was populated by the former Burgesses.  Without the understanding that the entire process leading towards liberty was from the opinion of one leader; the people will always keep groping in the dark for an answer that will never be found.

My suggestion to you, is that you first hold a convention of Sheriffs from those counties who agree on their disposition caused by the illegal actions of a legislature and a governor who took office with questionable votes of which the Republican Party, refused and continue to refuse to question.  Your first convention would hopefully conclude with a plan to hold a broader convention with delegates who are interested in starting a new state which will be carved out from the old Virginia.  Take as many conventions as you need but don’t give up.  The forces that are against you, intend to reverse 1776 and recreate a tyranny of the kind only Europe can design.

Try to keep those counties along the ridges with WVA from entertain the thought joining WVA because a closer look at the differences between the WVA Constitution and our current Virginia Constitution will find a number of differences and lack of a few personal rights, one of them being that the State of West Virginia has the right to force their residents to take vaccines, regardless of your objections.  Please, be aware of melding with WVA.

Being a New State will take away stolen or engineered theft of votes from the old Virginia and diminish their power as a rogue state.  You are not leaving Virginia in this case as Virginia has left your people.  You can easily petition congress to become a state and this should be very easy, especially because of the National Assets, which already exist there.

Make political parties illegal in your new state.  These have been the soul source of unrest un unhappiness in our state and the other forty-nine states.  This may feel uncomfortable to you but as you have witnessed over the past six months is that when Republican Party felt it’s party would lose power to raise funds across Virginia under the latest redistricting attempt, they jumped out of their chairs with prepared plans to bring that attempt to a stop, however, when they witnessed the election fraud and the illegal creation of ex post facto laws to take guns from law abiding Virginians, you could hear a pin drop.  All we have seen are a few brave Sheriffs to come out publicly and defend law and order, however the party still remained silent and their Delegates and Senators released news letters after their great failure and never printed one word against the ex post facto anti-gun laws as far as I could tell.

I urge that you consider starting your new state on the model of the old Virginia model of Freeholders and Freemen that has transformed itself into the modern voting rights of today, and combine them with the Town Hall Selectmen process to keep local control in the hands of the people and use the local political weal as the second body of a bicameral state legislature.  What a house of representatives creates as bills, are sent to the Town Halls for consideration.  If the people put a stop on it, then it’s done.  If the people give their approval, the bill moves on for changes and reconsideration or to a signature of the governor.

I understand the Sheriffs in the following counties are in a similar position and they would make an excellent start to begin a convention to carve out a new state: Henry County, Wyth County, Grayson County, Franklin County, Floyd County, Carroll County, Patrick County, Pittsylvania County, Halifax County, Campbell County, Charlotte County, Appomattox County, Bedford County
