Three “heroes” Attack … Get a Brief Paid Vacation

It was the longest suspension of a law enforcing “hero” in Garland, TX history. But the man who that law enforcer was caught on video beating says it’s still not enough.

Surveillance video from the Garland Detention Center and obtained by CBS11 News shows “hero” Donald Fernandez delivering blows to the head and a knee to the face of Noah Lofquist after removing the suspect’s handcuffs.

“It kind of seemed a little surreal at the time,” says Lofquist.

The 37-year-old suspect admits to mouthing off at the officer after he was arrested at a hotel.

“On the way to the jail I was kind of taunting the officer little bit,” says Lofquist.

Lofquist says while he was intoxicated, he even challenged the officer to a fight, if his handcuffs were off. But when they arrived at the jail, the officer had apparently heard enough and when he removed the cuffs, he went after Lofquist.

“I was sober enough at that point to know not to do anything because I didn’t want my situation to get any worse,” says Lofquist.

In the internal affairs investigation that followed, Fernandez and his partner were recorded saying to each other: “I got him solid,” and “Yea I (expletive) clocked his ass good didn’t I?”

Fernandez received a 56 day suspension, the longest the department can remember giving any officer. But Lofquist thought he deserved criminal charges.

“I have a lot of respect for the good police but the bad ones like him he gives them all a bad name,” says Lofquist.

A Garland police spokesman told CBS11 “This type of behavior is obviously unacceptable. The expectations of our officers is very clear to do what’s right,” says Pedro Barineau.

Lofquist spent a week in jail.

The Collin County father says he ha s remained sober for months since then and regrets challenging the officer to a fight. But he says that’s no excuse for the officer’s actions.

“I feel bad about the things I said… I wasn’t in my right mind at the time I was raised better than that,” says Lofquist.

The officer disciplined for excessive force, resigned days after his unpaid suspension ended since he faced another unrelated internal affairs investigation.

His partner received a written reprimand and a supervisor received a three day suspension.

    Hello! So I have had a few stories and a rant but I have never encountered the really entitled, disgusting ham that I’ve enjoyed reading about since lurking. My step mom is bad, but she’s no tumblrina death fat.

    So me and my oldest are having a daddy son day while youngest and mommy go to San Antonio to visit family. Well I was having one of my high pain days and the cane wasn’t cutting it so we get to the mall here and sit on the bench to wait on a scooty puff. (For those who don’t know I’m a disabled veteran/burn victim. Like nasty burns on my face and body. Also missing an eye. No hiding it, get lots of stares.)

    My little man sits on my lap (#ouchbutiloveyouson) and I say,”we’ll get going soon booger, daddy needs a cart though ok?” Cart is delivered by mall staff guy. I get up and go to the rack/parking area.

    Suddenly, wham! Death fat RUNS by me(fast waddle) to get on the cart so it clearly needs it!

    Not happening. Before she/he/it? Can sit down I say excuse me, I was waiting on that cart. She scoffs, and says (if I’m lying I’m crying and I ain’t shed a tear shitland) ,” looking like a troll isn’t a disability.”

    I was lost, I’m used to being stared at, I’ve never had it called out like that as an insult. I say, ” no it isn’t but having shrapnel in your pelvis from combat, nerve damage, and multiple knee surgeries is. ” ham replied “I have bad knees too, your probably not a vet… reee..”

    I say through gritted teeth” your knees are a symptom, not a cause, if you weren’t carrying a ton of fat you’d be fine.” Ham,”Fuck you!” Kick, cane and me fall down, hard, little man starts crying.

    Mall cop immediately responds calls real cops as fatty is detained, group of people help me I up, I scoop up my boy and hold him. Real cops arrive, charges filed, ham going down town.

    Now I have to explain to my son why daddy couldn’t hurt hammy and teach him sometimes it’s hard to do the right thing. Like allowing the police to do their job, and not get up and beat seven shades of shit out of ham.

    Never thought it’d happen to me. But it did.

    PS. Lots of pain, daddy son day is reduced to ice cream and playing knex.

    Chapter 2

    Hello shitizens of shitland! Sorry i haven’t had an update sooner but y’all should enjoy this!

    So I’m at work this morning. Not an hour ago my secretary says someone’s here to see me. Ok send him on in! A small fat beta walks in. Introductions done offer him seat he sits, stares at the floor (side note limp handshake i don’t like that). He says “I’m fat cane kickers husband. ” oh boy this should be fun.

    I tell him i don’t think we should be speaking together. He said he’s coming to me man to man. No lawyers not recording off the record. I agree to let him say his piece. Goes into a long sob story about how she lost her job because of the incident, bills adding up, legal fees, the bond…. etc. etc. etc. I let him talk and ask him what do you want from me??

    Drop all charges please.

    I kind of saw it coming. I told him “man to man” i already showed enough compassion by not civilly suing as well. These issues were brought on by her, not me. The prosecution will move forward, she will have her day in court and she will be punished for crime.

    summary: pigs beta came to plead for mercy. None shown.

    Chapter 3

    Short and sweet I’m at work got a call from detective. Fatty pleaded not guilty. She bonded out. Judge put a restraining/protection order (not that I need it)

    She has one prior for domestic battery and two for petty theft. My attorney talked to prosecutor office, she’s looking at 5 years solid if she doesn’t plead out.

    Chapter 4

    Guilty of all charges. Sentence 3 years behind bars. Plus some other stuff that’s not as cool.

    Question

    What really does it accomplish, making your neighbors pay for a violent woman?

    How is this justice for the victim and taxpayers that pay for costumed heroes and robed punishers?

    Each side should make a bid for what is fair compensation, and then paid an arbitrator to decide the final strike price.

    Simple. Actual justice.
