This is a report about the power of NO! – exercised during the height of “the pandemic” by a few and that’s the tragedy.

Had more of us said NO! to being told by “experts” (and teenaged door-minders) that they must wear a “mask” to enter – and that they must close the door to their store, restaurant or gym to those who wished to enter – “the pandemic” would have lasted a few weeks rather than several years.

One man who had the courage to say NO! is Ian Smith, who refused to close Atilis Gym in New Jersey, defying the decree of New Jersey Governor-Gesundheitsfuhrer Phil Murphy. Smith was arrested for his defiance and hit with more than 80 “citations” (and heavy fines attending) for having the gall to open the gym’s doors to people who were not forced to work out there.

This latter business is worth revisiting because it is not unlikely we’ll be dealing with something like it again.

After all, it’s an election year.

The last time sickness psychosis spread, people who were afraid of catching a cold were free to stay home. They were free to not go places where they feared they might catch a cold. No one was forced to leave home or go anywhere they didn’t want to go.

But people who were not afraid were told – were ordered – not to leave home and told they could not enter places where they wanted to go and where they were welcome, such as Atilis Gym – because it was open to the public.

This disease process begun decades prior to “the pandemic,” back in the mid-1960s, when private property became “public” property, as far as the law was concerned and the previously respected right of free people to freely associate was repudiated by establishing in law that people could be required to associate with those they’d rather avoid.

All of this was putatively done in the name of “civil rights,” by feigning that the matter was about remedying injustices done to blacks. But it became an injustice in itself because while it is one thing (a right thing) to assure that everyone has equal access to public places, such as schools financed by the public, it is another (and deeply wrong) thing to characterize privately owned places as “public” because the owners open their doors to the public.

A privately owned restaurant, store or gym is not owned by the “public” because the “public” does not pay the mortgage or rent or the taxes. Also, the “public” is a rhetorical device and rhetorical devices cannot own anything. The government is synonymous with “public” things because it controls things that people are forced to pay for and allowed to use – but that is a very different thing.

Private businesses such as restaurants and gyms are by definition not owned by the government and therefore ought to be under the exclusive control of the individual(s) who own them. These individuals have the same right to open – or close – the doors to their property as the owner of a private home does.

No one who is not an owner has a right to enter – or force the owner to deny entry to people he wishes to allow within, who freely wish to enter.

But the “civil rights” legislation of the mid-1960s gutted the concept of private property – and of free association, by imputing a “right” to force people to associate.

The owners of Atilis Gym said NO! to all of this.

Not just to the “COVID” stuff.

That was certainly the focus of the NO! – but implicit in that NO! is a much deeper, much more significant repudiation of the government’s assertions of ownership (via the control of it) over private property.

And that NO! was just vindicated. All of the “citations” have been flushed and – far more significantly – Gesundheitsfuhrer Murphy has been repudiated. It is worth republishing in full the entire text of the public exultation of the owners of Atilis Gym:

“4 years ago today, we reopened Atilis Gym in direct violation of an unconstitutional order by Governor Philip Murphy to close small businesses in New Jersey.

The support we received locally, nationally, and internationally for our stand is something I will be forever grateful for.

With that being said, I am thrilled to announce that we have achieved a major victory in the long, hard fight against the State.

ALL OF THE 80+ municipal citations of violations of a governor’s order, public nuisance, disturbing the peace, and operating without a license against us have been dropped by the courts WITH prejudice. This means the State has NO ability to revist or refile these charges.

This victory opens the battlefield again and gives us options to continue to push back and bring justice to the treasonous actions of Phil Murphy and his lackies.

Again, thank you to all who supported us. We could not have done it without you.

Special thanks to our fearless attorneys – John McCann and Giancarlo Ghione. Some of the most high profile attorneys around the country ran from our case – knowing it would be a long, hard road and would make them a target of the stare. These two gentlemen stood with us through the darkest days of the storm, have not flinched, and never once cared about being in front of cameras to gain notoriety from their work.

Vaccine companies even say that vaccines are a critical response to the climate crisis.     The few among us who steadfastly refused to wear a mask; who refuse to fly because to do so is to give up one’s most basic constitutional rights and be treated as a criminal, and have their possessions and very bodies violated; etc. are representative of just how infinitesimally small the ranks are of those who will stand with us vs. the ranks fo “them” -i.e. those (of whatever political affiliation) who will do what they are told and believe whatever propaganda is spewed by government and media, and who will actively see US as the enemy vs. their savior, the state. W e don’t have an army. Not even a tiny one.

    • Sadly, this is not new. If you believe the stats only 3% of the population actually fought the Revolutionary War. Contrary to various myths and legends, courage has always been in short supply.

      Your average human is somewhere between non-confrontational and and abject coward. Why be brave when that will get you: killed, hurt, imprisoned, financially ruined, ‘cancelled’. It is -far- easier to ‘go along to get along’ and thus, has it always been.

      On top of that, IQs and attention spans have dropped precipitously in recent decades. Your average American is truly and astonishingly stupid now. Midwits are considered ‘smart’ and the average intelligence of the population is bordering on retarded.

      This is a recipe for absolute apathy. Sheep and bugmen as far as they eye can see. That is why those few remaining who exhibit any bravery or resistance are made extreme examples of for the most part– Do not DARE step out of line.

      • It got me divorced. When my former wife’s father died, I refused to fly from Missouri to Florida for his funeral. I offered to drive, but she refused to accept that. I tried to explain that attempting to fly would only land me in jail the first time the TSA touched me.
        This is after 35 years of marriage.
        I stood my ground, and it cost me dearly, but I would do it again.

      I avoid flying – haven’t flown in several years. People think I’m crazy to drive cross country!

      2020 was enlightening to say the least. Who knew so very few cherished any semblance of liberty no matter how small and that so many would willingly destroy their own lives in so many ways.

      Before 2020 I believed most people at least had some instinct of self preservation for themselves and their children.

  3. Sadly, the swine in government still “won”.

    No one in government will be held to account for having issued the citations, for false arrest, or the legal bills which the owner had been forced to accrue. No government thug has lost his job. No parasite has apologized for their behavior. The fact that it took 4 years to get the citations dismissed says everything you need to know about the “just us” system in Merica’.

    This is why we can’t have nice things.

      Every one of those Goddamn cops that were involved in the arrest(s) should be shunned from polite society. No restaurant, barber, grocery store, etc. should ever agree to do any business with them.

  4. There is another way…around all “civil-rights” mandates and laws, as well as the blatantly unconstitutional covid plandemic mandates.
    Establish your business as a private club. Charge a nominal “membership fee”. Doing so makes the business owner the arbiter of who is allowed to become a “member” and gain access.
    Another example of a partial “end run” around the unconstitutional “civil-rights” laws is the establishment of HOAs. (Homeowner Associations). After real estate “restrictive covenants” were banned, HOAs were established to keep out the “riff-raff”. Although not strictly racial in nature, they can be used to “keep neighborhoods clean”.

      We have a constitution in name (or on paper) only. No one in Government abides by it.

      Same for laws. The law is what the thugs and clowns in gowns say what it is.

      The current state of “the law” is capricious and arbitrary. We are now a lawless society in practice.

      The sooner people learn the power of No, the better off they will be as Eric has pointed out.

          • The Articles of Confederation was working like it supposed to. It kept the central federal government weak and without any way to spend money. It couldn’t tax and had to ask the states for money, which the states almost always refused. That’s why the federalists assassinated it.

            If they had actually wanted a government for the “people”, they could have added the bill of rights to the Articles and been done.

            Imagine we would have avoided many tragedies over the years had we stuck with the Articles. Most likely no civil war, staying out of the world wars just to name a few.

            The easiest way to keep a government from violating your rights. Keep it weak so it CAN’T!

  5. A news article provides more insight about the gym owners’ legal and business strategy:

    ‘Attorney John McCann said summonses were written by the Bellmawr Police Department, but the cases were later transferred to Winslow Township Municipal Court due to a conflict. “Those charges hung over these guys’ heads for over four years,” McCann said.

    On April 24, a judge in Winslow Township dismissed the charges but gave the prosecutors until this week to appeal.

    “We didn’t get a lot of cooperation from Bellmawr with regard to discovery. The only thing we got with regard to discovery was the summonses,” McCann said Tuesday.

    “You need the reports, you need a whole bunch of stuff. The judge in Winslow said Bellmawr didn’t provide their court with meaningful discovery to give to us,” McCann said. “She basically said that Bellmawr ignored the requests.”

    So the gym owners won, but mainly because of municipal incompetence. The local court didn’t issue any ringing defense of freedom, unfortunately. This was clever, though:

    ‘McCann said Atilis’ owners did not make money off gym memberships during the pandemic. The facility, for that period of time, became the campaign headquarters for Republican U.S Senate candidate Rik Mehta, who challenged Democrat Cory Booker for his U.S. Senate seat.

    People entering Atilis were exercising their right to volunteer for Mehta’s candidacy. If they worked out while they were there, they were not charged a membership fee, McCann said.

    “There was no income coming in but for the GoFundMe money they were raising to fight the state,” McCann said. The GoFundMe raised more than $530,000 for the gym owners’ cause.’

    When the state won’t respect individuals’ rights to freedom of association, invoke the freedom of association inherent in a political campaign. Checkmate for GovCo! 🙂

    • Hi, Jim. Unfortunately that is a winning strategy because the whole illegitimate system will come together to suppress anyone who simply says,” NO. You don’t have that power. You are my servants and I am your master.”

      Until a critical mass of people come together and say no and back down the enforcing thugs, it continues. Same as it ever was. It worked for the Viet Cong, it worked for the Taliban, it would have worked for the CSA except for misguided leadership, it worked for the American revolution.

  6. Speaking of the outcomes of those who stood up and said no to masks and shots. I also do not know one person who declined the vaccine, including gym owners and trainers who has gotten sick, or worse, gotten an unusual disease or horrible turbo cancer we have seen in a few of our friends and relatives. Supporters love to tout the correlation is not causation mantra, but these are just facts that have observed. I think many people in the public who declined to take boosters relied on their personal observations to come to similar conclusions, despite what the media hyped over and over.

    • There comes a point where correlation and causation are obviously related. For example, young athletes dying on the field.

    Love it. I admire Mr. Ian Smith for standing on principle and calling out the governor in his statement. And, it’s a rare moment to admire attorneys –specifically the two who defended him.

  9. Indeed the “civil rights” act of the year I was born is one of the two most insidious pieces of communist fiat that exists. The other one nobody thinks about is the civil service act.

    This is not a democracy, and democracy is totalitarian communism. Without the ability to refuse to associate with people you don’t want to you have no freedom. And if its racist to love your country, your family, your heritage above that of savages and barbarians, then I am proudly a racist.

    Leftists equate racism with hate, but they are as wrong about that as they are about everything.

    And if the people you vote for cannot sweep out the dregs and follow travelers from all aspects of government, if they cannot fire enemy hirelings and hire those more in keeping with the agenda of the country then voting is a meaningless sham and a farce.

  11. And always remember, Jim Crow LAWS were what mandated not serving negroes at the time. It was a GOVERNMENT contract bus that Rosa Parks took a seat. It was the government that passed the laws. Virtually all the governments that did so were dominated almost exclusively by Democrats. You know, Democrats like Maxine Waters, Chuck Shumer, et. al.

    By not striking down the laws that mandated segregation and instead mandating integration, our country has been devastated.

    Our country now rests on the principle, Those in Government Will Decide, You, Citizen, have no say.

    • What you said, Mark. It was the GOVERNMENT owned transit authority in Montgomery that was segregated by order of the GOVERNMENT of the State of Alabama and the City of Montgomery.

      It was state, county, and city GOVERNMENTS that imposed segregation.

      At the risk of getting flamed (gotta put on my Nomex racing gear) what was true of Jim Crow is also true of anti-Semitism: It was and is GOVERNMENTS that were largely behind it: from ancient Egypt, Greece, and Rome to the Third Reich, Soviet Union, and the Islamic Republic of Iran.

      That is reason #45,678 why governments need to be kept small and their powers kept limited and in check.

      • True “anti-semitism” doesn’t exist. In fact, the current definition of “anti-semitism” is labeling anyone who does not agree with jewish behavior as being “anti-semitic”.
        This label is used in the same way that “racist” label is being used.
        Both labels are used to suppress free speech and political power…nothing more.
        Keep in mind that most (if not all) European jews are not “semitic” at all, but are European converts to judaism.
        A prime example of this is Netanyahu (nee Miliekowsky) who is Polish and has no semitic DNA. He was born in New Jersey and can make no claim to being “semitic”.

  12. The first thing that needs to happen in order to regain some sort of sense of freedom in this country is that those who complied with the bioweapon shots must own up to their choices. Excepting children and those people in nursing homes who were forced to take the shots, EVERYONE ELSE freely took the shots. There was no coercion. It doesn’t matter if you were going to lose your job or couldn’t travel or go to school or whatnot. It was an individual choice with consequences. Every choice has
    consequences.

    Those of us who chose to make the immediate choice of NOT complying with the shots suffered immediate consequences from the covid me-too freakout fascists. Those who chose to comply did not. Now those compliers are complaining about the delayed consequences from their individual choices. They are placing the blame on everyone but themselves, and crying “corecion!” Suck it up buttercups. That gym owner did and suffered more than most of those compliers ever did.
    That gym owner’s choice to stay open builds up freedom in society. The compliers’ choices to wear a face diaper or take a poison shot or close their business cuts down freedom.

    I guess I’m getting tired of hearing the whining from people screaming “we didn’t know. We were tricked!” You knew and made your free choices with glee.

    • I hear more along the lines of “you should have told us”-to those of us who did not get jabbed, are not sick, while they are. Somehow, it is our fault they got the jab, and are now suffering. Even though they were the ones who were more than glad to have us un-jabbed lose our jobs, homes, and livelihoods because we said “no”. In the end, somehow, we are responsible for their stupidity. I do not know how, but they say we are.
