Oh, Thank You, Massa!

It appears the state of Oregon may legalize Kei trucks – which are small, export-market trucks made by Japanese and Korean manufacturers – but only those at least 25 years old.

We are supposed to be grateful.

It is a measure of our unconscious servility – as a people – that we take such crumbs tossed from the master’s table as a boon rather than an insult, hurled with contempt in our direction. How did we – as a people – become so habituated to this business of accepting that it is the government’s rightful business to tell us what kinds of vehicles we’re allowed to buy? More finely, to threaten us with violence if we dare to buy – and drive – a vehicle the government – this gang of thugs – has decided we ought not to be allowed to buy or drive?

Yes, violence.

Threatened – and actual. Both serving the same purpose. If you manage somehow to buy a vehicle that the government – federal or state or both – says cannot be sold in this country, usually on the pretext that it is not “safe” or “clean” (meaning it does not fully comply with all the federal and state regulations, which is not the same as being unsafe or dirty) the goons employed by government will treat you to the Hut! Hut! Hut! Meaning, they will seek you out and forcibly take your vehicle – that you bought with your money from someone willing to accept in return for the vehicle; i.e, on a free exchange basis. They will force you to hand it over and if you “resist” – as what was once understood to be self-defense is now commonly styled by the goons enforcing the laws – you will be physically assaulted, perhaps killed. Definitely “arrested” – meaning, they kidnap you just any other gang might do, except the other gangs (the illegal ones) have the honesty and decency to not call it “arresting.” They just kidnap you. And they would never have the effrontery to tell you what kind of car you’re allowed to buy – though they might try to steal it.

The government won’t allow you (in most states) to “register” the unapproved vehicles – such as the Kei trucks. That is, beg for government permission to be allowed to use them on the government’s roads. This is changing in Oregon – maybe. A few other states have already deigned to grant the serfs permission to buy and register the Kei trucks, but – once more – only those that are at least 25 years old. The newer models – let alone the brand-new ones that you can buy outside the United States – are disallowed.

Here we come to an interesting thing. The government says the brand-new ones are not “safe” and “clean” and that is the pretextual basis for not allowing people to buy them. But the government allows people – in some states – to buy (and register) the same kinds of vehicles if and only if they are at least 25 years old.

Now, if anything, these 25-year-old-and older Kei trucks are less “safe” and less “clean” by dint of the fact that they are 25-years-old-or older and are both old (and so by definition no longer in new/perfect operating condition) and made 25  or more years ago, when vehicles were not as “safe” or as “clean” as they are now, in terms of advancements made in both categories over the past quarter-century.

But we’re allowed – oh, thank you massa! – to buy and maybe register the 25-year-old ones. Why the exception? Why, because after 25 years there aren’t many 25-year-old Kei trucks available that are in serviceable condition. Put another way, there are vastly more brand-new ones available – at least potentially. They are being stamped out right now in the thousands. In the tens of thousands. If it were legal to import these and legal for people who wanted to buy them to do so, there would plenty to choose from.

But that isn’t allowed – even though these brand-new Kei trucks and other illegalized vehicles such as the $13,000 Toyota HiLux Champ pickup are objectively safer and cleaner than a 25-year-old vehicle of the same type, if only because the brand-new vehicle’s frame will be pristine rather than rusty and its brakes will be in perfect operating condition and it won’t be riding on dry-rotted tires, either. The engine will be tight because it is new and that means it will run cleaner than a 25-year-old engine.

Never mind these facts.

The only fact that matters is that were the government to allow the importation of brand-new Kei trucks and any other vehicles people wanted to buy there would be alternatives to the kinds of vehicles the government wants to force people to buy. It creates a “market” for the latter by disallowing the former.

When there’s just one size, it fits all.

Oregon State Senator Anthony Broadman says “small businesses, farmers, and Oregonians across our state are asking for practical, cost-effective transportation options. This legislation simply makes it legal to use a tool that’s already proving useful across the Pacific Northwest.”

Oh, thank you boss! You a good massa! No massa better’n you, massa!

A free people does not beg permission to be free. It just is.

And that’s why we aren’t.

  1. Im curious – why hasnt someone out in some place in Asia figured out a way to make K trucks and register them 25 years ago to get around the government and export to the US ! That is really the American (and Asian) spirit !

    • Morning, Nasir!

I think because any company that did so would get persecuted to the nth degree, a la VW and Cummins. As individuals, we can monkey wrench but don’t expect corporations to go to bat for us. They are part of the problem.

  2. I dunno where else to drop this: are you ready for mirror-riots? A.k.a. a repeat of the crazy destructive BLM mega-B.S. riots of 2020?

I hope, nothing comes of it and it’s a Dud.

The last go-around in 2020, was nutz.

Doug from YT-landia shows you the pamphlet encouraging it from one of Sam Walton’s spawn in this video:

‘They said “JUNE 14TH We will burn it all down” WARNING!’

    https://www.youtube.com/watch?v=hf7jLkdO70E

…I dunno about you guys, but things got super-screwed-up crazy in the QCA on the last go-around, and I don’t wanna be anywhere near that stupidity this time,… If, it happens.
    Which, I hope, it don’t.

…If you’re clueless, you just got ~ 3 days notice.

    …In 2020, I was clueless. About, that.

[Pickup truck full of guys with open carry parked on the street just under my bedroom window as I slept, laughed as they walked up to my neighbors house (because he flew the flag of the Empire?) & tossed a Molotov Cocktail into his bass boat parked on the street, then walked away laughing more as the flames shot up 20′ and blew a football-sized hole out the side while the cop neighbor called-it-in on his phone while he stayed inside with his tiny dog watching it all on his Ring-whatever.]

That was, ‘the sheet’ all across the town that night. Reminds me of a story/history about doing evil, just on one night. But, I digress.

    • Hi Bill,

I have an almost 30 year old truck that I like and want to try to keep running as long as possible given what I’ve read about newer vehicles on Eric’s site and elsewhere. I’m sure the corrupt governments in Salem & DC would say it’s “Dirrrrrrrrrrrrrrrrrrrrrrrrty!” & not “Saaaaaaaaaaaaaaaaaaaaafe!” If Salem does try to force people who like their older vehicles to give them up, citing cliiiiiiiiimate change or saaaaaaaaaaaaaaaaaaaaafety, hopefully there’ll be a MASSIVE “HELL NO!” from the masses.

      • Salem? As in, Massachusetts?

From this view, West of The Mississippi, you’re in the minority, you’ve been over-run.

I don’t get why you East Coaster’s stay out that way.

…Not that it’s perfect anywhere else in The Land of the Flea, but, still.

I reckon there’s about a 99.99% chance that 30yr. old trucks get outlawed in Iowa. Out your way? Well, they did just have a court case nullifying The Second Amendment. Do you hear any, ‘Peeps’?

        I wish you good fortune.

  3. Those Hijets are Everywhere in 3rd…..Uummm…developing nations,

Though they look weird and front end cab loaded, the 6 ft bed with drop down sides provides other-worldly FUNCTIONALITY! …

As I’ve literally watched the amerikant empire disintegrate over the last generation…
Guess what “USA, USA” types …..You are entering the Third World…”Mas Rapido”..

I’m genuinely glad to be 68+ and have experienced the post WW2 boom…….

    “Good Night and Good Luck”…..

    • ‘6 ft bed with drop down sides provides other-worldly FUNCTIONALITY!’ — expat

Fold-down bed side walls would actually make Americlown monster pickups usable for — you know — loading stuff in the bed.

Fantastic idea — someone should patent it! So much more convenient than steps and ladders.

  4. Lithia Auto Group is based in Oregon. They don’t want the competition from kei truck importers, and they dont want the hassle of low margin sales and service on the Hilux at their Toyota stores.

Texas passed a similar law with a 25 year restriction to protect the dealer groups based in this state.

  5. “to threaten us with violence”

Have you seen the “resisting without violence” charge cops are using? Are you kidding me? You can be arrested and charged for disagreeing.

  6. The comment section is full of geniuses. Somehow the subject of Key trucks gets connected to the evils of Judaism, in one swell swoop.

    • You and Philo apparently aren’t interested in the CAUSE of this police state, the CAUSE of the denial of our rights.

So, the question is: Are you stupid, or are you crypto-jews?

(If you reply, you’ll get the last word. I will not

      • Why, I am not a crypto-jew. I am a Jew, proud of it.

I may also be stupid, but I see evil-minded people doing evil things as the cause of the police state. Some of those people are good old Christian folks, some atheists, some are secular Jews, a handful are pretending they are religious Jews.

What I don’t see, no matter how hard I try, is the bad apple Jews doing their bad things “qua Jews”, just as I don’t see the bad Christians doing bad things as part of their Christian doctrine, whatever denomination and church they belong to.

What I also see is that good white folks, by and large, control the machinery of the state violence, the army, the police, the “security” and “intelligence” agencies. They have all the guns at their disposal, and no filthy rich Jew is holding a gun to their heads to make them do what they are doing.

What do you think of this picture?

      • “Are you stupid, or are you crypto-jews?”

        I’m neither.

I’ll not be suckered into the lazy lumping of individuals into sortable sub-groups for expediency. Let’s identify and eliminate the bad ones, the individuals.

All joos bad. All wypipo bad. All negroids baaaad.

        Who’s stupid? And lazy?

        • Well-said, Philo – thank you!

One cannot logically be a libertarian and someone who thinks in terms of groups. Collectivism is always pernicious because it always derogates the value of the individual. Nothing good ever came of that as far as I can tell.

          • Libertarians say the damnedest things because they don’t want to accept reality so they live in a fantasy land. In a perfect world with high levels of social capital and trust it might be possible to the ignore racial, religious or cultural backgrounds of our fellow shitizens, but not today as Judeo-Mestizo communists are trying to start an insurrection.

In the world of today not only are there hundreds of these groups with varying levels of moral fiber competing for resources and wealth, there are are also numerous groups who are performing planning and operating on this in secret.

One of these groups considers itself to be “god’s chosen people” who claim to have a right known as “tikkun olam” to reorganize the entire planet to their satisfaction. They have a secret book known as the Talmud that they for centuries hid from Christian Europeans that instructs them on how to accomplish this feat.

Over the last 1000 years, this group of people has been thrown out of at least 109 countries over 1000 times for their incessant scheming to gain control of society and warp it to their own purposes.

This goup of rootless cosmopolitans were not only responsible for the communist “revolutions” of the last century, but were also the group primarily responsible for both world wars that lead directly for the slow motion genocide of the Palestinians that they are gleefully forcing us to watch in real time. Jews actually took pride in how they were able to booby-trap pagers and walkie-talkies and cause them to explode causing death and maiming of thousands of innocent people.

This group of chicken swinging chosenites were also directly responsible for the rise of the NSDAP and the holocaust of Germans after the war. After overseeing the murder of tens of millions of ethnic Russians, then ethnic Germans, this group then came up with the phony and laughable claim that the Germans gassed and cremated 6 million Jews in the waning years of the war while their entire transport system had been carpet bombed to a standstill.
This fable that the Jews have concocted has now become its own religion known as “the holocaust” that they are forcing on the entire planet through their war against free speech, which Eric would have us believe is the Libertarian holy grail.

            • “Libertarians say the damnedest things”

We don’t only say the damnedest things, we live by the damnedest principles, often to our disadvantage. We swim in a sea of ignoramuses who spew forth and act out vile collectivist concepts. We try our best to live and let live, but that’s just a little bit more than the law will allow. So we shovel a path through your BS and live our lives the best we can without attracting the attention of the violent collectivists because we are grossly outnumbered and know that righteous self defense against your kind will ruin us in this world you have created.

    • I’m not sure how Judaism is related to Japanese micro trucks, so I don’t know what you’re talking about… unless Eric deleted something I can’t see.

    • “Somehow the subject of Key trucks gets connected to the evils of Judaism, in one swell swoop.” – AG

So you admit that there are evils of Judaism?

Use the word ‘supposed’ or the word ‘purported’. The purported evils of Judaism, you are off the hook then.

You indict yourself when you say that there are evils of Judaism. You become complicit.

You must be careful of how words look on paper.

      Time for more beer.

      • You can twist and turn my words each and every way because you are mentally fixed on one point only. So yes, have more beer – while I continue to laugh at your tireless efforts to push a square peg through a round hole.

  7. One state, any state, needs to declare itself a Vehicular Sanctuary State and let you register what you want to drive, or simply forego registration altogether. Right now, that would have to be a “Blue” state because no “Red” state would rebel against the regime of the Orange Menace. Of course, Blue states are run by leftists who have no desire to let you drive what you want, which is why I’ll be surprised if the Oregonian rulers follow through with this.

Though they might. The second sentence of the cited article states: “If passed, the state would become the latest to take direct action to protect these vehicles when they comply with the Federal Motor Vehicle Safety Standards.”

(In a menacing synthetic voice) “Please put down your Kei truck. You have 10 seconds to comply.”

  8. Looks like just the right type of vehicle for high density, heavy traffic areas. I’m thinking LA. Perfect for finessing your way through the myriad sub-human freeway blockades while hauling filthy communist rabble from pre positioned pallet to pre positioned pallet. Might also make a good delivery vehicle for crates of Molotov cocktails.

  9. Kei trucks, Toyota Hiluxes, et.al. are, in reality, the kinds of vehicles we need if we are serious about reducing pollution (if you believe CO2 is a pollutant).

The surest way to reduce pollution is to Burn Less
Fuel. These vehicles Burn Less Fuel to make, to run, and to scrap.

Yet we cannot have them—we must have EVs that pollute and are dangerous.

Because it’s not about controlling the climate—it’s about controlling YOU.

  10. The mere existence of DMV should be questioned.
Had to surrender tags myself at the DMV yesterday – a 70 minute wait for a 2 minute transaction – that cost me $1 for the transaction.
Of course you overhear the tales of woe of all the fellow inmates…..errrr…..citizens while in line.
One guy had a pile of papers trying to get a used boat & trailer registered and this was his second visit. Had his phone out showing photos too as the DMV “examiner” kept going back and forth to the supervisors office to discuss this like it was a capital murder case.
Not sure how it turned out, but the fact that the government inserts itself in private transactions between adults shouldn’t exist in the first place.

  11. Oh, goody, I can buy a KEI, thank you so much.

I recently read in an NIH publication that Americans who are 67 years and older have at least five prescribed medications. In the same publication, Dwight D. Eisenhower ingested rat poison to prevent cardiac arrest. It worked.

Don’t tell anybody, but those prescription drug users are hooked, tethered, to the Medical Industrial Complex.

Drug slaves, as it were. The drugging will continue until your health improves!

It’s a conundrum, a malaise, a maelstrom, a vortex, a whirlpool, all swirling down the drain.

Trump the Clown is making sure things get worse, and things are worse now than before.

Biden would have strafed the protesters with F-16s, so it isn’t that bad… yet.

“Those who make peaceful revolution impossible will make violent revolution inevitable.” – Jack Kennedy

    Are we there yet?

    • ‘Dwight D. Eisenhower ingested rat poison to prevent cardiac arrest. It worked.’ — drumphish

Well, sort of. Ike had a heart attack in Denver on Sep. 24, 1955. Maybe the thin air got to him. Then he had a stroke in 1957 that affected his ability to speak … and another heart attack in 1965.

On the other hand, strychnine can’t be any worse for you than statins … or mRNA ‘vaccines.’

Leeches would work wonders for POTUS … not that there aren’t plenty in Foggy Bottom already.

  12. That’s weird, given that Oregon is one of those states with this demented EV push, but leave it to Oregon to push weird, insane, stupid, or even nonsensical bills.

Speaking of Oregon government, there was a state representative who recently tried to put a bill banning biological men from competing in womens’ sports up for a vote, but the self-proclaimed “Party of women” in the legislature said NO. Some propagandized people would say that “transgender women” in womens’ sports is no big deal, but I’ve heard countless stories of biological women athletes who’ve been defeated by biological men who CLAIM to be women.

    • That state Rep. is Dwayne Yunker of Grants Pass. I call him the “Junk Yard Dog” ‘cuz he doesn’t tolerate the prog bullshit agenda. Unfortunately there are other Republicans in the Oregon Legislature who insist their job is to “reach across the aisle” and “Show the Democrats what good people we are so they’ll see the error of their way”/sarc. Yeah, the Washington Generals always playing to lose against the Globetrotters.

      • Unfortunately Bill, the Republican Party at the state and federal level have become the party of wimps or Swamp creatures, while the Democratic Party has become either f***ING insane or Swamp creatures themselves.

        • Good morning, John!

I think the GOP is being true to its roots. It is and always has been the party of consolidated federal authority; to expect this party to be a party interested in limited government is a little like expecting a pedophile to stop watching little kids at the park.

PS: We watched Technocracy last night. It was depressingly excellent. I hope others here will watch it as well.

          • Hi Eric,

I registered as a Republican shortly after my 18th birthday, given that Bill Clinton was President at the time, and I was not a fan of him. But looking back at Clinton’s successor, I’m ashamed that I voted for him twice, but on the other hand, his opponents in those 2 elections were also bad. Could you imagine if we had a President Al Gore and he was trying to shove the climate change scam down everyone’s throats while making BIG BUCKS in the process? Or John Kerry, who is also on board with the scam.

As for that film, I’m surprised You Tube allowed it to be posted on their site given they’ve censored lots of other people and groups who went against establishment narratives on things like COVID, the mRNA COVID jabs, face diapers, climate change, etc. If more people watch that film and realize the agenda these technocrat sociopaths have planned for us, hopefully we can stop it for at least another 90 years.

  13. Even if these trucks are “allowed” to be registered, let’s face it, they’re shitboxes designed for the Japanese market for short people on a crowded island. They’re the four-wheeled equivalent of 50cc domestic Japanese motorcycles.

Sure, they might be handy around the farm or the property, but let’s face it they’re not any better than a side-by-side. You’re not going to drive one across the state, let alone across the country.

But this isn’t Japan, this is by-God ‘MURICA. 50-60 years ago when you needed a cheap truck, you bought an F-100 with a six and a three-on-the column. It was basic but it was still a REAL truck and a real piece of “Detroit iron.” Failing that maybe you got a Ranchero or El Camino. Much better suited to the U.S. than the foreign microcars.

    • I agree, X –

But it’s the principle at issue that matters. In a free country, people are free to buy and drive whatever suits their needs and their means. But we do not live in a free country, do we?

      • These things are used in old cities in Italy for local deliveries all the time…..I would not want to be in one at any speed in a busy highway environment. The crumbling infrastructure and the lower standard of living is what the elites expect of the plebes as they continue to piss away real resources on endless wars and in support of the totally corrupt MIC, medical industrial complex, big pharma, big ag, insurance mafias and so forth. This system has to collapse, reform is impossible and quoting the constitution is likewise ineffective. Fourth Turning in progress.

        • Slow as a dog on highways, at least with a load.

Got behind one last weekend with a couple of hay bales in the bed.

It slowed to around 35 mph going up the mildest of hills.

    • X, I agree.
I just looked it up and they are around 10K for decent 25yr old units. Bonus is enclosed cab, probably heat. And cargo capability is way better than SxS’s
The cheapest Polaris Ranger starts at 12K and they go up well into the 20’s (granted new), but these cheapest units are not enclosed and cost a pretty penny to do so.
I think the SxS market is more for recreation use than work, but IDK for sure.
The unit that I thought would take over was the Mahindra Roxor, but their base model now starts at 22K and to 30K for enclosed, but great little diesel and very capable relative.

      • I was just thinking. The best little trucks for farms, etc… would be like Eric’s older Frontier, or like the old small Ranger. Wish they still made them.
Or like that new Hi-lux that Eric showed for $10-15. But likely will never happen again in the US. The must limit competition.

        • It’s possible to bring Hilux or Kei trucks in and never register them for street use if you use them on a farm. This whole argument is a smoke screen, not unlike SxS that want street legal status. If you own a farm you can get implement tags for moving equipment around that even allow you limited use on roads. So that’s not the point. It’s various manufacturers protecting their turf. The Roxor is almost identical to the original Jeep CJ2A in size and build. If it was allowed to be sold it would be an embarrassment to the current Wrangler in performance vs cost. So they hide behind safety or whatever to prevent having to sell a cheap, reliable, capable vehicle.

        • I should add that if you do bring in a brand new non-US legal vehicle for use off highway such as on farm or mine the vehicle can’t later be registered at 25 years like other overseas imports without exporting it and re-importing it through legal CBP and DOT channels. Which just goes to show the whole depth of nonsense and red tape.

        • Yes, 100%.

In 2001 I bought a ’99 Ranger base, 2wd 5-speed, no a/c for $4600 including tax with 60k on it. I drove it for 13 years to 213k and it still ran like new when I sold it, but it was rotted. Taught my daughter how to drive a stick in it and she took her road test with a stick. She LOVED that lil’ truck.

Brand spanking new I doubt that truck was much more than ten grand. The idea of getting a three-year-old truck today for four grand and change seems preposterous, but they were out there back then and they were fantastic.

Inflation is a crime against the people…

          • Morning X!

My ’02 Frontier stickered for about $12k when it was new. I bought it when it was about six years old for $7,000. I could prolly sell it today for $4,000 – not that I would. Because the thing is worth its weight in gold, almost!

  14. ‘Oh, thank you boss! You a good massa! No massa better’n you, massa!’ — eric

Truly the strangest pretension of ol’ Massa Uncle Sam is his obsession with the nuclear power program of Iran — a country on the other side of the world — coupled with a government-wide ban on speaking about Israel’s trove of 100 to 200 unregulated, uninspected nuclear weapons.

This flaming, reckless hypocrisy may finally be coming to an end:

‘Iran’s intelligence minister Esmail Khatib claimed Sunday that Tehran seized an “important treasury” of info regarding Israel’s nuclear program.

‘Israel, whose undeclared atomic weapons program makes it the only country in the Mideast with nuclear bombs, has not acknowledged any such Iranian operation targeting it.

‘Khatib said members of the Intelligence Ministry “achieved an important treasury of strategic, operational and scientific intelligence of the Zionist regime and it was transferred into the country with God’s help.”

‘He claimed thousands of pages of documents had been obtained and insisted they would be made public soon. Among them were documents related to the U.S., Europe and other countries, he claimed, obtained through “infiltration” and “access to the sources.”’ – AP

    https://tinyurl.com/bdebyu6e

Anyone with a lick of sense supports nuclear transparency in the middle east. Ol’ Massa Sam’s mindless, unconditional support for mad-dog Israel constitutes the No. 1 risk of planetary nuclear destruction.

Let us hope the Iranians aren’t bluffing about their smoking gun documents, and ol’ Massa’s perfidious treason on behalf of the Israeli pariah regime is exposed for all to see.

  15. The sad truth here that likely even Eric Peters is not aware of is that Jews had an almost complete monopoly on the slave trade throughout the US, the Caribbean, and South America from its inception. Slave markets were closed on the Sabbath (saturday) because that was a Jewish holiday.

So when Eric sarcastically says that we should be grateful for getting a few Kei crumbs from our Jewish masters at the US table today, this is not only accurate in that we slaves are treated the same way then and now, but also in the way the real master has not changed over the centuries.

      • Judaism still considers slavery (of goyim) to be a valid human condition. Judaism has never renounced that “peculiar institution”.
When the “messiah” arrives, every jew will have 2800 gentile slaves.
“They will work, they will plow, they will do whatever we want while we sit like effendi and eat”.
Judaism itself is a mental illness that needs to be scrubbed from the earth.
        Proof?
Jews are taught from birth that they are “special” and that all other human beings are “lesser beings, on a lower spiritual plane, created solely for and given long lives in which to serve the jews”.
At the same time, jews are told that they are hated merely for being jews, conveniently ignoring their nefarious behavior toward gentiles.
This “duality” is a dichotomy which results in mental illness due to the human inability to reconcile the two opposing concepts. It’s no different than a computer program which is stuck in an infinite loop.
Getting “clipped on the eighth day after birth”, jewish males receive their first molestation at the hand (mouth) of their dirty “mohel” receiving STDs in the process.
We are seeing the “fruits” (destruction of gentiles) of judaism with the present-day situation in the middle east and elsewhere.
Proof of jewish chutzpah and ignoring the “rule of law” is the jewish kidnapping of the flotilla crew despite the crew being in international waters.
It is my humble opinion that judaism cannot be reformed, but must be outlawed worldwide.
In the interim, requiring every jew in the USA to register as an “agent of a foreign government” would be a god start.

        • Being told from birth that you are better than your fellow man and they exist to serve you is bound to imprint some rather twisted memes on your brain. I would note that particular conceit is not exclusive to Jews, but is found in pretty much every tribal society. Whites had tribal societies too, but their importance diminished long ago. I consider this unfortunate.

  16. In North Carolina we have Annual Inspections for Safety and Emissions. However, if you vehicle is 20 years old and your Check Engine Light is on, that’s OK…you pass. If you’re vehicle is 30 years old, no inspection at all. Your one year old Mercedes, however, is a climate destroying death trap unless proven otherwise.
